These Terms and Conditions ("Terms") govern your use of the IgniteMD Connect platform and the educational services we provide. They should be read with our Privacy Policy and Refund Policy. By registering, paying a fee, or using the platform, you agree to these Terms. If you do not agree, you must not use the services.
These Terms are intended to comply with South African consumer and electronic-commerce law, including the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), the Protection of Personal Information Act 4 of 2013 ("POPIA") and the Children's Act 38 of 2005. Nothing in these Terms limits rights you have under those Acts that cannot lawfully be limited.
IgniteMD ("we", "us", "our") operates IgniteMD Connect, an online learning and youth-development platform for South African high school learners.
These details are provided in terms of section 43 of ECTA.
"You" means the person who registers or uses the platform. If the learner is under 18, the contracting party is the parent or legal guardian, who accepts these Terms on the learner's behalf and remains responsible for the account, fees and the learner's compliance. The learner is a user of the services.
Our services are intended for learners in Grades 8 to 12 at South African schools. You must provide accurate information (including a valid South African ID number and contact details) and keep it up to date.
If the learner is under 18, a parent or legal guardian must consent to registration, to these Terms, and to our processing of personal information as described in the Privacy Policy. By completing registration you confirm that this consent has been given.
A parent or guardian may request access to academic records, ask us to correct information, or cancel the account by emailing support@ignitemd.co.za.
Depending on the plan and programmes you enrol in, we may provide:
Tutoring is educational support. We do not guarantee any particular mark, university admission, bursary award or other outcome. Attendance, effort and school work remain the learner's responsibility.
After registration we issue a learner account. Access is by email and a PIN that you set. You must keep your PIN confidential and tell us promptly if you think the account has been misused.
We may suspend or close an account if fees are unpaid, if these Terms are breached, if we reasonably believe the account is being used unlawfully, or if we are required to do so by law. We will give notice where it is reasonable and practicable to do so.
Fees are quoted in South African Rand (ZAR) and are as shown at registration and in your learner account. They may include:
If we are required to charge VAT, it will be indicated at the time of payment. We may update fees on reasonable written notice; the new fee applies from the next billing cycle after that notice.
You may pay by card through Paystack (we do not store card numbers) or by EFT to the bank details we provide, using the payment reference given. EFT registrations and monthly EFT payments are activated once we have verified proof of payment. Card payments are confirmed when Paystack notifies us that the charge has succeeded.
Monthly tuition is billed in advance. If a payment is overdue we may withhold academic access until the account is up to date.
If you conclude this agreement electronically, section 44 of ECTA gives you a right to cancel without reason and without penalty within seven days of concluding the agreement, by emailing support@ignitemd.co.za. We will refund amounts paid, less any reasonable cost of returning goods if applicable.
This cooling-off right does not apply where we have begun performing the services with your consent (for example, the account has been activated and tutoring, mentorship or a programme has started), or in the other cases listed in ECTA section 42 and 44.
If you entered this agreement as a result of direct marketing, you may also have a five-business-day cooling-off right under section 16 of the CPA.
The same rules are published on our Refund Policy page. After the cooling-off period (or where it does not apply), the following applies, always subject to your CPA rights for services that are defective, not performed, or not performed to the standard reasonably expected:
Where you paid by card through Paystack, we refund to the original payment method via Paystack. Where you paid by EFT, we refund by EFT to the South African bank account you nominate. We process agreed refunds within 15 business days; card refunds typically appear in 3–10 working days after we initiate them.
Exposure programmes, visits and camps may have limited seats, eligibility rules and their own start times. Enrolment is not confirmed until any required fee is paid (or, for EFT, verified) and we confirm your place.
We may change dates, venues or format for operational or safety reasons. If we cancel a programme entirely, we will refund the programme fee. We are not responsible for your travel or related personal costs unless the CPA requires otherwise.
You (and, where relevant, a parent or guardian) are responsible for the learner's conduct, safety instructions, medical disclosures and any indemnity forms we reasonably require for in-person events.
You agree that you will not:
We may remove content, restrict features or close an account for breach. Serious misconduct (including child-safety concerns) may be reported to parents, the school or the authorities as the law requires.
The platform, IgniteMD name and logo, lesson materials, recordings and software are owned by us or our licensors. We grant you a limited, non-transferable licence to use them only for the enrolled learner's personal education while the account is active.
Work the learner submits (assignments, messages, project work) remains theirs. You grant us a licence to store, mark, display to assigned tutors and use that work to deliver and improve the services. We may use anonymised examples for training our team.
Grades, attendance and certificates on the platform record participation in IgniteMD programmes. They are not a substitute for a school's official report or a Umalusi NSC result. Certificates are issued at our discretion where completion criteria are met.
We aim to keep the platform available, but it may be interrupted for maintenance, load, or events outside our reasonable control. We may update features from time to time. If we discontinue a paid service entirely, we will refund unused prepaid fees for that service.
How we collect, use and protect personal information is set out in our Privacy Policy. That policy forms part of these Terms.
We will provide services with reasonable care and skill, in a manner and of a quality that persons are generally entitled to expect (CPA section 54). If we fail to do so, you may have the remedies in the CPA, including requiring us to remedy the defect or refunding a reasonable portion of the price.
To the extent permitted by the CPA, we are not liable for:
We do not exclude or limit liability for death or personal injury caused by our negligence, for gross negligence, for fraud, or for any liability that the CPA or other law does not allow us to exclude. Where our liability can lawfully be limited, it is limited to the fees you paid us in the three months before the claim.
We may update these Terms as the services evolve. Material changes will be posted on this page, dated above, and announced on the platform. If you do not agree to a material change, you may cancel under section 8 before the change takes effect. Continued use after that date means you accept the updated Terms.
Please email support@ignitemd.co.za first so we can try to resolve the issue. If we cannot, you may approach:
Nothing in these Terms requires you to waive CPA rights or to litigate in a forum that is unreasonably inconvenient for you as a consumer.
These Terms are governed by the law of the Republic of South Africa. If any clause is found to be unlawful or unenforceable, it is severed and the rest remains in force.
